1. Merchant of Record
All purchases of Daw-Timizer PRO+ are processed by Polar Software, Inc. ("Polar"), who acts as the Merchant of Record. Polar handles payment processing, tax collection (VAT, GST, sales tax), invoicing, and refunds. By completing a purchase, you enter into a transaction with Polar, subject to Polar's Terms of Service.
Andy Prinz Publishing is the developer and licensor of the software. These terms govern your use of the software after purchase.
2. License Grant
By purchasing Daw-Timizer PRO+, you receive a personal, non-exclusive, non-transferable license to use the software on up to two (2) machines simultaneously. The license is tied to your license key and machine fingerprints. The license is perpetual (no expiration) as long as these terms are not violated.
3. Permitted Use
- Install and use the software on up to 2 computers you own or control
- Deactivate and re-activate your license when changing hardware
- Use the software for personal and commercial music production purposes
4. Restrictions
- You may not redistribute, resell, sublicense, or share your license key
- You may not reverse-engineer, decompile, or modify the software except as permitted by mandatory law
- You may not remove or alter any proprietary notices or branding
- You may not use the software for purposes that violate applicable laws
5. Pricing, Payment & Delivery
The introduction price for Daw-Timizer PRO+ is CHF 49.- (subject to change). This is a one-time payment with no recurring charges. Applicable taxes are calculated and collected by Polar at checkout based on your location and are displayed before you confirm payment.
Delivery: Daw-Timizer PRO+ is a digital product. Upon successful payment, you will receive your license key and download access via email. Delivery is digital only — no physical goods are shipped. You can access your license key and downloads at any time via polar.sh/purchases.
6. Right of Withdrawal (EU Customers)
Under EU consumer protection law, you may have the right to withdraw within 14 days. For digital content delivered immediately upon purchase, that right may not apply once delivery has begun and you have acknowledged this. By completing your purchase and receiving your license key, you consent to immediate delivery where applicable.
If you experience technical issues that prevent you from using the software, please contact us. Refund requests can be submitted via [email protected] and are handled case-by-case through Polar.
7. Warranty & Conformity
Andy Prinz Publishing warrants that Daw-Timizer PRO+ will perform substantially as described on the product website at the time of purchase. The software is designed to analyze and modify Windows system settings for audio production workflows and creates automatic restore points before applying many fix operations.
For EU customers: Digital content must conform to the contract. If the software does not function as described, you may be entitled to remedy, price reduction, or refund under mandatory law where applicable.
Important: Always create a full system backup before applying optimizations or repairs. Andy Prinz Publishing is not liable for system damage, data loss, or issues arising from use without adequate backups.
8. Limitation of Liability
To the maximum extent permitted by law, Andy Prinz Publishing shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed the purchase price paid for the software. Mandatory consumer rights remain unaffected.
9. Intellectual Property
Daw-Timizer, Daw-Timizer PRO+, and associated branding are the property of Andy Prinz Publishing. All rights reserved. A license purchase does not transfer intellectual property rights.
10. Termination
Your license may be terminated if you violate these terms. You must then cease use and delete copies. You may deactivate your license via polar.sh/purchases.
11. Governing Law
These terms are governed by the laws of Switzerland. Disputes shall be subject to the competent courts in the Canton of Zurich, Switzerland, without depriving EU consumers of mandatory protections in their country of residence.
12. Changes to Terms
We may update these terms. Changes are posted here with a revised date. Continued use after an update constitutes acceptance where permitted by law.
